On March 31, 2016, in a long awaited fifteen page decision in the Southern District of New York (Tacopina v. Kerik et al, No. 1:2014cv00749 (S.D.N.Y. 2016), both Kerik's counterclaims and third-party complaint against Joe Tacopina's attorney Judd Burstein were dismissed. This clears the way for trial preparations to being this coming October, 2016. Parlatore reportedly works pro bono for felon on probation Kerik (on this an many other cases/legal matters) so funding a high-profile trial may be the highest form of friendship and altruism on behalf of Parlatore's new "partnership" with virtual law frim FisherBroyles.com
We all remember a very bitter libel-proof felon on probation Bernard Kerik and his pro bono, flamboyant, media whore attorney, Timothy Parlatore, making defamatory statements exclusively to their former co-defendants, The New York Daily News. In this long-standing bitter feud between felon on probation, Bernard Kerik and his former best friend, business partner and attorney, Joe Tacopina, Kerik through Parlatore and the New York Daily News, have accused Joe Tacopina of "racket law firm, had affairs with TV stars and abused drugs". This defamation was also translated into a bar complaint against Tacopina (which has since also been flatly dismissed). This defamation and sliming of the opposition in the media and in court documents is a familiar modus operandi in Timmy Payne Parlatore's"legal tactics" . We saw a similar tactic in the "From Jailer to Jailed" copyright infringement case against Kerik. On the day that case was filed, Parlatore was quoted in "The Daily News" calling the plaintiff in this case a "stalker". In later filed "letters" to the court, Parlatore slimes the Co-Author Plaintiff, without any evidence, as "mentally ill" and a "stalker". If Parlatore's legal skills were as good as his sliming skills, he may just win a case!
Judd Burstein describes Parlatore perfectly by Law360.com in saying, "“This was, in over 30 years of practice, perhaps the most frivolous complaint I’ve ever encountered,” Burstein said. “Exacerbated by a lawyer (Parlatore) who failed to understand that good lawyering doesn’t involve making unfounded allegations and getting them in the newspaper.”
Partying, Newsmax non-sensical, talking head, felon Kerik, reportedly still owes over $500,000 to the US government in arrears criminal restitution and residual IRS tax liens. Could another million or so going to Tacopina make a difference?
On or about October 15, 2016, Kerik is due to be released from US Supervised Probation. Maybe the US government will finally compel Kerik to pay his full debt to society which may mean Kerik gets a real job with less photo opportunities in the New York Daily News and fewer parties.
This upcoming libel-proof Felon on Probation Kerik v. Famed attorney Joe Tacopina trial may just be good entertainment as we watch Tacopina's attorney, Judd Burstein, eat Kerik alive...in a legal sense of course. Kerik apparently has it coming...good riddance. Find a place on the comfy couch and get the popcorn, Kiddies. This is going to be fun to watch......
